1. Acceptance of Terms

Welcome to Playspot, a search and referral service platform (hereinafter referred to as "the Service" or "the Platform") operated by Playspot Company Limited (hereinafter referred to as "the Company", "we", or "Playspot"). By browsing, accessing, or using the Platform, you agree to be bound by these Terms of Service (hereinafter referred to as "these Terms"). If you do not agree to these Terms, please stop using the Service immediately.

2. Platform Nature: Information and Referral Intermediary

Playspot is an information search and referral platform for Hong Kong entertainment venues. The Company is not the owner, lessee, manager, or operator of any venue, nor does it act as an agent for any venue.

• •The Platform provides venue information for users' reference and helps users contact relevant venues.
• •All bookings, payments, refunds, and transaction arrangements between users and venues are made directly between the user and the venue operator. The Company is not a party to such transactions.
• •The Company is not responsible for and makes no warranties regarding the quality of venue services, condition of facilities, opening hours, pricing, or any transaction terms.
• •Some venue links may redirect to official venue websites or third-party booking platforms. The Company is not responsible for any external websites or their services.

3. Venue Information Accuracy Disclaimer

Venue information listed on the Platform (including but not limited to name, address, phone, opening hours, price, facilities, and verification status) is sourced from public data, information provided by venues, or third-party sources, and is marked with verification status (such as "Verified", "Partially Verified", "Pending Verification", etc.).

While the Company makes every effort to ensure the accuracy of the information, it does not guarantee that the information is complete, up-to-date, or correct at any given time, nor does it guarantee that venues remain in normal operation. Before booking or visiting any venue, you should independently verify the latest information directly with the venue.

The Company does not fabricate venue ratings or reviews. If venue information is inaccurate, please contact hello@playspot.com.hk to submit a correction.

4. User Responsibilities

By using the Service, you agree to:

• •Provide accurate, true, and complete personal information (where applicable).
• •Not use the Service for any unlawful purpose or in violation of these Terms.
• •Not interfere with or disrupt the normal operation of the Platform, including not using automated tools to scrape data in bulk.
• •Not upload or disseminate any unlawful, defamatory, infringing, or offensive content.
• •If you are under 18 years old, you must use the Service with the consent and supervision of a parent or legal guardian.

5. Booking and Payment Terms

• •When you make a booking through the Platform, you are entering into a contract directly with the relevant venue. The Company acts as a technical intermediary to facilitate the booking but is not a party to the contract.
• •Payment is processed by third-party payment services such as Stripe. The Company does not store your complete bank card information.
• •Cancellation, modification, and refund policies are subject to the terms published by each venue. The Company does not guarantee refunds.
• •Prices displayed on the Platform are for reference only; actual charges are subject to confirmation by the venue. Prices do not include any additional taxes or service fees (if applicable).
• •The Company complies with the relevant provisions of the Ordinance on Misleading and Deceptive Conduct (Chapter 362). All discounts or offers are based on the normal pricing of the venue; the Company will not create false impressions of discounts.

6. Intellectual Property

All intellectual property rights to the design, logos, trademarks, original text, and code of the Platform (collectively, "Company Content") are owned by the Company or licensed for use by the Company. You may not copy, modify, distribute, or use Company Content for commercial purposes without the Company's written permission.

The intellectual property rights to venue names, trademarks, and related information are owned by the respective venue owners. The Platform lists venue information for the purpose of providing public information services. If you have any intellectual property concerns, please contact hello@playspot.com.hk.

7. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any of the following matters (including direct, indirect, incidental, special, consequential, or punitive damages):

• •Any decisions you make based on information on the Platform (including visiting venues or making bookings).
• •Situations where venue services fall short of expectations, venues cancel or modify arrangements, or venues close.
• •Service interruptions, technical failures, or data loss on the Platform.
• •The content or conduct of any third-party website or service (including official venue websites, external booking platforms, etc.).

8. Amendment of Terms

The Company reserves the right to modify these Terms at any time. The amended Terms will be published on this page with the "Last updated" date updated. Your continued use of the Service after such amendments constitutes your acceptance of the amended Terms. If these Terms are significantly changed, the Company will make reasonable efforts to notify registered users through the Platform or email.

9. Suspension or Termination of Service

The Company reserves the right to suspend, modify, or terminate the Service (or any part thereof) at any time without prior notice. The Company shall not be liable to you or any third party for any such suspension or termination.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Both parties agree to submit to the non-exclusive jurisdiction of the Hong Kong courts for any disputes arising from these Terms or the Service.
